Foot of the Mountains (ABN 97 265 149 435) (FOTM) is committed to protecting your personal information.  This Privacy Policy sets out the details relating to your data relationship with FOTM and applies to services and interactions with FOTM. The personal information we collect about you depends on the dealings you have with us. Personal Information includes information about an individual who is reasonably identifiable. You have the option of interacting with us anonymously or using a pseudonym, however in some instances this may prevent us from being able to provide you with products and services, for example where you place an order for products online.

Use of Cookies

Information is automatically collected through your use of the FOTM websites. FOTM do not use the cookie information collected for marketing purposes.

Why we collect personal information

We collect your personal information to provide, administer and improve our products and services, and to support our business functions, including:

  • to provide you with products and services including our FOTM loyalty program
  • to manage and work with our service providers to fulfil your request for products and services such as processing transactions and payments, delivering products and services, providing refunds and discounts, to register and keep your information up‐to‐date, and verifying your identity
  • to conduct investigative, fraud and loss prevention activities to protect FOTM’s interests including protection of our store, staff, customers, suppliers and merchandise (including theft and fraud prevention)
  • to respond to your query, feedback or concerns
  • responding to and interacting with regulatory bodies and relevant government agencies
  • general planning and administration, as required or permitted by law
  • We may also collect, hold, use and disclose personal information for other purposes explained at the time of collection or which are required or authorised by or under law, and for which you have provided consent.

We will not use your personal details to send you marketing spam or provide your details to a third party for use except in the following circumstances:

  • approved technology services including application and systems, cloud computing facilities, development and technical support, processing, storing and hosting
  • business advisors, including lawyers, accountants, insurance, auditors or other professional service providers to the extent reasonably required
  • regulatory, investigative or government bodies to comply with applicable laws or respond to valid legal process such as a search warrant, a court order or a subpoena and fraud management

 

Protection of personal information

Personal information we hold can be in electronic or hard copy form, both onsite at a FOTM premises or with our trusted service providers. Any trusted service provider must observe and meet our information security requirements to minimise the risk of unauthorised access to, loss, misuse or unapproved alteration of, personal information.

We have security controls in place to protect your personal information. All of our electronic information is password protected. The only hard copy personal information is kept using the hard copy lay-by record as a back up to the electronic system.

VEND and Information Protection

Vend is our Point of Sale and Inventory management system. It is used for all in store and online inventory management and sales. It is integrated with our FOTM Loyalty Program, Marsello.

Vend is committed to protecting the privacy of the individuals on Vend’s websites, mobile applications, products and services, (collectively, “Services”). As a Subscriber to Vend,  FOTM is an entity that registers to use Vends Services.

By using VEND, FOTM acknowledge the collection, transfer, processing, storage, disclosure and other uses of business and customer information, as described in Vend’s Privacy Policy. Vend has no direct relationship with individuals whose personal information they process in connection with Services provided to FOTM.

FOTM provides information to Vend only as necessary for the implementation and management of Services provided by Vend and for no other reason.

FOTM is the controller of employee or customer information and should be contacted directly regarding any requests relating to the management of your personal information as it related to Vend.

Marsello and Information Protection

Marsello is a provider of rewards and recognition services to merchants. They provide merchants (FOTM) with the ability to collect personal information about consumers so that they can optimize and improve the promotions and rewards that Marsello suggests to merchants (FOTM), which the merchants (FOTM) may then offer to consumers (at the merchant’s discretion). Collecting this information enables Marsello to let merchants  (FOTM) know what type of promotions and rewards consumers like and actually use so that they can offer consumers targeted promotions. As a merchant, FOTM are separately obligated to act in accordance with those privacy laws that apply in Australia.

If you are a FOTM consumer, Marsello will collect personal information about you on behalf of  FOTM when they provide services to us, including:

    • your name, email address, phone number
    • location
    • the products and/or services purchased by you
    • the value of your purchase
    • time and date of purchase
    • rewards or discounts applied/redeemed.

Marsello collects this information when:

    • you register as a customer of FOTM;
    • you accept any rewards or promotions offered to you by FOTM;
    • you purchase goods or services from FOTM;
    • you supply any additional information to FOTM

FOTM only collects personal customer information and enters it into the Marsello system, via the Vend platform, after gaining informed consent from each customer. The customer is then opt in to the system.

WordPress Website Platform
